
I think it is rather commonplace at best and a bit unusual at worst to find a servicemember who refuses to deploy to wherever the Commander in Chief – in this case President Barack Obama – sends him to. The rationale for these servicemembers’ refusal to deploy are different, some good and some not so good.
Yet there is at least one servicemember who refuses to deploy for a reason that just may make sense – because Obama is not a natural U.S. citizen and as such is not his Commander in Chief. The soldier in question? U.S. Army Major Frederick Cook.
Cook’s lawyer, Orly Taitz, filed a request last week in federal court seeking a temporary restraining order and status as a conscientious objector for his client; in the 20-page document – which was filed on July 8 with the U.S. District Court for the Middle Court in Georgia – Taitz asks the court to consider granting his client’s request based upon Cook’s belief that Obama is not a natural-born U.S. citizen and is therefore not eligible to serve as Commander of Chief of the U.S. Armed forces.
Cook further stated that he,
“would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. … simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”
The document also states that Cook has been ordered to report to MacDill Air Force Base in Tampa, FL on Wednesday; from there, he would then go to Ft. Benning, GA before deploying overseas. Perhaps some finality to this matter will be forthcoming as a hearing to discuss Cook’s request will take place in federal court on Thursday at 9:30 AM.
This is one of those cases where I am torn. As a servicemember, you’re supposed to deploy upon receiving orders from the Commander in Chief – even if this person is one Barack Hussein Obama. On the other hand, Cook does have a legitimate point in reference to Obama’s actual place of birth. We keep hearing that Obama was born in Hawaii while also hearing that he was born in Kenya, as well.
But nonetheless, because he is an active member of the U.S. armed forces, I think it behooves Cook to go ahead and report to MacDill AFB and let the chips fall where they may. By being an officer, he apparently has a lot of time invested in a career in the military and I would hate to see that go to waste because of his beliefs – as correct as they very well may be.
More often then not, the courts will not allow servicemembers to receive “conscientious objector” status, especially if you’re an officer. but then again, there is the outside possibility that the court may rule in Cook’s favor, so Thursday will tell the tale of the tape. Personally I hope the court rules in Cook’s favor, but I will not be surprised if they rule otherwise. Whether an appeal will take place is really speculative right now; however, should more information become available, The Republican Temple will have it for you.
